The process for purchasing real estate
STEP01
Real Estate Appraisal
We will conduct a basic investigation of the property you wish to sell, such as the property's condition and rights. Based on the results, we will present you with an appraisal price.
STEP02
Intermediary Service Agreement
Once you have decided to sell your property, you will be required to enter into an agency agreement to select us as your agent in accordance with the Real Estate Transactions Act. We will provide you with a signed contract as evidence of the agreement. There are three types of contracts: (1) non-exclusive agency agreement, (2) exclusive agency agreement, and (3) exclusive agency agreement.
STEP03
Submission of documents
The real estate purchase and sale contract must clearly state the current state of the property for sale and the conditions for handing it over to the buyer. Therefore, the seller must prepare a property status report and a list of facilities as soon as possible after concluding the agency contract.
STEP04
Finding a buyer
Property information is published and potential buyers are solicited.
Since we have many wealthy inbound customers, we also have a wide range of buyer guidance.
STEP05
Negotiating with buyers
Once we receive offers from potential buyers, we negotiate price and other terms with them in a timely manner.
STEP06
Sales contract
Once an agreement is reached, a sales contract will be prepared and signed between you and the buyer.
Before concluding a contract, we will directly explain important matters to the customer to ensure that they clearly understand the contract terms.
Please note that the "Explanation of Important Matters" will be conducted by a person qualified as a real estate transaction agent.
We also assist sellers in explaining the "Property Status Report" and "Facility List" to buyers.
After the contract is signed, the buyer pays a deposit or key money and deposits it into a bank account.
STEP07
Transfer the property
On the delivery (settlement) date, the buyer shall pay the remaining purchase price.
The seller shall deliver to the buyer all documents necessary for the transfer of ownership registration and the keys.
In addition, matters to be shared between the seller and the buyer, such as property taxes, will also be settled on the day of delivery.
The seller is obligated to pay the seller's brokerage fee pursuant to the brokerage agreement.

Seller's brokerage fee
The seller's commission is calculated as follows:
Purchase price: 8,000,000 yen or more Brokerage fee: 3% of purchase price + 60,000 yen + consumption tax Purchase price: less than 8,000,000 yen Brokerage fee: 300,000 yen + consumption tax

Generally, escrow is rarely seen in Japanese real estate transactions. To avoid the buyer depositing funds directly into the seller's account, we recommend using the broker's bank account or the judicial scrivener's (or lawyer's) bank account. Which one to use is up to you.

Withholding tax on real estate sales by non-residents
When a non-resident or foreign corporation sells real estate in Japan, the buyer must pay 10.21% of the purchase price as withholding tax to the Japanese tax authorities. This means that the seller receives 89.79% of the purchase price. If the withholding tax exceeds the actual capital gains tax payable by the seller, the seller can receive a refund by filing a tax return.
In addition, the buyer is not required to pay this withholding tax if the following two conditions are met:
(1) The purchase price is 100 million yen or less, and (2) the buyer intends to purchase the property as a residence for himself or her or her family.
